Ten Ohio Firms Win Injunction Against State Hemp Beverage Ban

A federal judge blocked enforcement of Ohio's intoxicating hemp law against ten named companies, leaving every other business in the state still barred from selling the same products.

GREAT LAKES, July 23, 2026: Ten Ohio companies may keep selling hemp-derived THC beverages that remain illegal for everyone else in the state, under a federal preliminary injunction reported this week.

U.S. District Judge Jeffrey J. Helmick granted the order on July 13, barring enforcement of Ohio's intoxicating hemp restrictions against the plaintiffs, according to the Ohio Capital Journal. The companies, among them Saucy Seltzer LLC, Grayscale Brewing LLC, Precision Fill and Pack LLC, and Titan Logistics Group LLC, had sued nearly 100 county and municipal prosecutors' offices to block enforcement against them.

Senate Bill 56, effective March 20, amended Ohio's voter-approved marijuana law to prohibit intoxicating hemp products, pulling delta-9 seltzers and similar drinks out of bars, bottle shops, and gas stations. The injunction leaves that prohibition intact for every business that was not a plaintiff. The state has asked the court to stay the order.

The practical effect is a two-tier market inside one state, in which the lawfulness of a given hemp beverage turns on which company made it. Retailers stocking the category now have to track products back to their producer to know whether a sale is permitted.

In Minnesota, two dates fall in the coming week. The Office of Cannabis Management's annual petition period, through which any person may ask the agency to approve new cannabis product categories or declare a cannabinoid nonintoxicating, closes at 4 p.m. on July 31. On August 1, the state drops its bar on a single owner holding both cannabis and hemp business licenses, under the 2026 cannabis omnibus. Rep. Jessica Hanson, the bill's lead House sponsor, described that provision as a bridge for hemp operators facing the federal hemp redefinition scheduled for November 12.

Illinois is pointed at the same deadline. Senate Bill 3222, passed at the close of the 2026 regular session, aligns the state hemp definition with the coming federal standard and routes products above the threshold into the regulated cannabis system.
