Ohio, Missouri and Wisconsin's pending hemp beverage legal challenges remain undecided as the region logs a second straight quiet week for hemp beverage law and business.
MIDWEST, September 22, 2026: The Midwest's three pending hemp beverage legal fights, in Ohio, Missouri and Wisconsin, remain undecided for a second straight week, with none of the region's courts issuing a ruling.
In Ohio, the Sixth Circuit Court of Appeals has not set an argument date or ruled on the state's bid to overturn a preliminary injunction shielding ten hemp companies from Senate Bill 56's restrictions, in a case now fully briefed on both sides. A second federal injunction won September 4 by a separate group of plaintiffs, including Fifty West Brewing, Great Lakes Brewing and Rhinegeist, also stands unchallenged. In Missouri, a federal judge has not ruled on the state's motion to dismiss a hemp industry lawsuit over House Bill 2641, whose beverage-only carve-out keeps Missouri hemp drinks on shelves through December 11 regardless of the outcome. In Wisconsin, the Seventh Circuit has not acted on Wisconsinites for Alternatives to Smoking and Tobacco's September 5 appeal seeking to block the state's hemp-inclusive vape product directory enforcement.
No Midwest state advanced new hemp beverage legislation, rulemaking or enforcement action this week, and no regional brand or distributor reported a notable business development.
