New Jersey Hemp Beverage Sales Move to Licensed Cannabis Retail in November

New Jersey's liquor-store window for intoxicating hemp beverages closes November 13, though the state's own guidance and secondary summaries differ by a day on the exact cutover.

NORTHEAST, October 16, 2026: New Jersey liquor stores may sell intoxicating hemp beverages only through November 13, after which only businesses licensed by the state Cannabis Regulatory Commission may sell them, according to a Scarinci Hollenbeck summary of the law Gov. Mikie Sherrill signed March 30.

The Commission's own January 28 FAQ says products above 0.4mg total THC per container become cannabis starting November 14, one day after the date cited in the law firm's summary. The Commission has not published guidance specific to the transition, and a bill that would allow hemp beverages in larger containers, A5051, was last reported on Assembly second reading in a May public comment.

In Connecticut, HB 5350 replaces the 3mg per-container cap with 5mg at package stores and 10mg at dispensary facilities and other retailers. The General Assembly's bill analysis lists an October 1 effective date, though that analysis describes the committee version of the bill.

In New York, hemp beverages sold outside dispensaries remain limited to 1mg per serving and 10mg per package. Chelsea Davis, a deputy secretary under Gov. Kathy Hochul, told the New York Post last month that unlicensed sales could become a governor's priority next year.

In Pennsylvania, Sen. Dawn Keefer's proposed Hemp and Cannabinoid Act remains a cosponsorship memo.
